1. About StreamerServices

StreamerServices is a marketplace designed to connect customers seeking services with independent professionals who offer those services.

StreamerServices may provide features for discovering providers, viewing availability, communicating, booking services, making payments, managing orders, and reviewing completed services.

Unless explicitly stated otherwise, StreamerServices is not the provider of services listed by independent marketplace providers.

2. Marketplace Relationship

Providers using StreamerServices operate independently.

A provider is responsible for the services they advertise, sell, perform, and deliver.

Customers are responsible for determining whether a provider and service are appropriate for their needs before purchasing.

StreamerServices provides marketplace technology that facilitates connections and transactions between users.

Nothing in these Terms creates an employment, partnership, joint venture, franchise, or agency relationship between StreamerServices and a provider merely because the provider uses the marketplace.

3. Accounts

Certain StreamerServices functionality may require an account.

You agree to provide accurate information and keep relevant account information current.

You are responsible for activity occurring through your account and for maintaining the confidentiality of your login credentials.

You may not impersonate another person or create an account using information you are not authorized to use.

4. Eligibility

You must satisfy any minimum age and legal capacity requirements displayed during account registration or required by applicable law.

Providers must be legally permitted to offer and receive payment for the services they list.

5. LIVE Status

StreamerServices may allow providers to indicate that they are LIVE or currently available.

LIVE generally means the provider has indicated that they are available to interact with potential customers.

LIVE status does not guarantee immediate response, immediate service delivery, a particular completion time, that the provider will accept every request, or that a transaction will occur.

LIVE status also does not necessarily mean that the provider is broadcasting a public video livestream.

6. Provider Responsibilities

Providers are responsible for accurately describing their services.

Providers must not intentionally misrepresent their identity, qualifications, experience, availability, pricing, service scope, expected deliverables, credentials, portfolio work, or other material information relevant to a customer's purchasing decision.

Providers are responsible for performing purchased services professionally and in accordance with the agreed service description and applicable law.

7. Customer Responsibilities

Customers are responsible for reviewing service information before purchasing.

Customers must provide providers with information reasonably necessary to perform the purchased service.

Customers may not use StreamerServices to request unlawful, fraudulent, abusive, dangerous, or otherwise prohibited services.

8. Service Listings

Service listings should clearly describe what the customer is purchasing.

StreamerServices may remove, restrict, or require modification of listings that violate these Terms, applicable policies, or law.

The existence of a listing on StreamerServices does not constitute an endorsement or guarantee of the provider or service.

9. Payments

When paid marketplace functionality is available, customers may purchase services through StreamerServices.

Payments may be processed through a third party payment processor such as Stripe.

Users may also be subject to the payment processor's applicable terms.

Prices, marketplace fees, processing charges, taxes, and other amounts applicable to a transaction should be displayed as required before the transaction is completed.

10. Provider Earnings and Payouts

Provider earnings, marketplace fees, payout eligibility, payout timing, reserves, holds, and other payment rules will be governed by the provider terms and payment information presented when paid marketplace functionality becomes available.

StreamerServices will not rely on an unpublished payout schedule.

Providers are responsible for providing accurate information necessary to receive eligible payouts.

11. Taxes

Users are responsible for taxes applicable to their own activities except where StreamerServices or a payment provider is legally required to collect, report, withhold, or remit taxes.

Providers are responsible for determining tax obligations associated with income earned through their services.

12. Cancellations and Refunds

Applicable cancellation and refund rules will be displayed before paid marketplace transactions are made available.

Customers and providers must comply with the policies applicable to their transaction.

StreamerServices does not promise refunds outside the applicable published policy or requirements of law.

13. Communications

Users may communicate through marketplace features made available by StreamerServices.

You may not use communications to harass or threaten another person, send spam, commit fraud, distribute malware, request illegal services, share unlawful content, attempt to manipulate marketplace systems, or engage in other prohibited conduct.

14. Reviews and Ratings

Where review functionality is available, reviews should reflect genuine marketplace experiences.

Users may not purchase fake reviews, sell reviews, coordinate fraudulent ratings, threaten users to obtain favorable reviews, or submit reviews for transactions they did not genuinely participate in.

StreamerServices may investigate or remove reviews that violate applicable policies.

15. Prohibited Services and Conduct

You may not use StreamerServices to offer, request, promote, facilitate, or conduct activities that violate applicable law or StreamerServices policies.

You may not commit fraud, impersonate others, exploit or harm another person, circumvent platform security, distribute malicious software, attempt unauthorized access to accounts or systems, manipulate marketplace metrics, create fraudulent transactions, use stolen payment information, interfere with platform operation, scrape or harvest information in violation of applicable law or platform restrictions, or use StreamerServices to facilitate unlawful activity.

Additional marketplace policies may identify categories of prohibited or restricted services.

16. Intellectual Property

StreamerServices and its associated software, branding, interfaces, designs, logos, and original platform content are protected by applicable intellectual property laws.

Except where expressly permitted, you may not copy, reproduce, distribute, modify, reverse engineer, sell, or exploit StreamerServices proprietary materials.

17. User Content

Users may upload or submit content including profiles, service descriptions, portfolio materials, messages, reviews, and other content.

You retain ownership of content you own.

By submitting content where necessary for platform operation, you grant StreamerServices a nonexclusive license to host, store, reproduce, display, format, distribute, and otherwise process that content as reasonably necessary to operate, promote, secure, and improve StreamerServices.

You represent that you have the rights necessary to submit the content you provide.

18. Copyright and Rights Complaints

StreamerServices may remove content that infringes intellectual property rights.

A process for submitting appropriate copyright or intellectual property complaints will be made available as required.

19. Platform Enforcement

StreamerServices may investigate suspected violations of these Terms or marketplace policies.

Depending on the circumstances, we may remove content, restrict marketplace features, remove listings, suspend accounts, terminate accounts, restrict transactions, and take reasonable steps to protect users or the platform.

We may also cooperate with lawful requests from appropriate authorities.

20. Third Party Services

StreamerServices may rely on third party infrastructure and services, including payment, hosting, analytics, communication, authentication, or other technology providers.

Use of certain third party services may also be governed by their own terms.

21. Availability of StreamerServices

We work to maintain reliable access to StreamerServices, but uninterrupted availability cannot be guaranteed.

Features may change, experience interruptions, be temporarily unavailable, or be modified as the platform develops.

22. No Guarantee of Marketplace Results

StreamerServices does not guarantee that a customer will find a provider, a provider will receive customers, a provider will earn a particular amount, a LIVE provider will respond immediately, a service will produce a customer's desired business or personal outcome, or a particular marketplace opportunity will remain available.

Providers remain responsible for their services and customers remain responsible for evaluating services before purchasing.

23. Disclaimers

To the extent permitted by applicable law, StreamerServices is provided on an "as is" and "as available" basis.

Nothing in these Terms excludes warranties, rights, or remedies that cannot legally be excluded.

24. Limitation of Liability

To the maximum extent permitted by applicable law, StreamerServices and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the platform.

Any additional limitation of liability applicable to paid marketplace activity should be finalized with legal counsel before launch and presented in compliance with applicable law.

25. Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses resulting from your unlawful use of StreamerServices, violation of these Terms, infringement of another person's rights, or services you offer through the marketplace.

The final scope of any indemnification obligations should be reviewed before paid marketplace launch.

26. Account Suspension and Termination

You may stop using StreamerServices at any time.

StreamerServices may restrict or terminate access when reasonably necessary because of violations of these Terms, fraud, security concerns, legal requirements, or conduct that creates material risk to users or the platform.

27. Changes to StreamerServices

StreamerServices is actively developing.

Features, marketplace functionality, policies, pricing, and availability may change.

Material changes affecting users will be communicated where required.

28. Changes to These Terms

We may update these Terms as StreamerServices evolves.

Updated Terms will be posted with a revised effective date.

Where required by law, additional notice or consent will be provided.

29. Governing Law and Disputes

The governing law, jurisdiction, dispute resolution procedure, and any arbitration provisions should be finalized based on the legal entity operating StreamerServices and its jurisdiction before paid marketplace transactions launch.

Do not automatically add mandatory arbitration or a class action waiver without appropriate legal review.
